Today, in City of Ontario v. Quon, the Supreme Court granted cert in an appeal of a Ninth Circuit ruling that an employee police officer had a privacy right to text messages sent on a city police department phone. This case will likely provide additional guidance to employers on workplace policies and practices with respect to cell phone use, text messaging and email.
